I have been a qualified mediator since 1985 and am also a trained arbitrator. As a lawyer, I have represented people in mediations and arbitrations, so I know the process from all sides. Mediation Versus Arbitration

Many people enter into an agreement to “mediate/arbitrate.” Mediation is attempted first. The mediator guides the parties toward agreement on issues in dispute. If the parties are unable to reach a settlement through mediation, pursuant to the agreement to mediate/arbitrate, the mediator can become an arbitrator. The arbitrator, unlike the mediator, has the authority to impose a binding settlement, acting in effect, as a private judge.

By far, most people who enter mediation/arbitration settle during mediation. The process is particularly appropriate for families with unique issues to address in a divorce. These might include special needs children, religious issues and financial affairs that parties would rather not be made public. Indeed, the process is sealed and confidential.
